Not Again! Cop cleared in chokehold death of Eric Garner

A Staten Island grand jury cleared an NYPD cop Wednesday in the chokehold death of Eric Garner during his caught-on-video arrest for peddling loose cigarettes, The Post has learned.

The panel voted a “no-bill” and dismissed all potential charges against Officer Daniel Pantaleo, sources said.

The blockbuster decision capped weeks of investigation by the special grand jury, which was empaneled in September specifically to review evidence in Garner’s racially charged death.

It was unclear exactly what charges prosecutors asked the grand jury to consider filing, or how the vote went.

Under New York law, an indictment must be agreed upon by at least 12 members of a grand jury, which can have up to 23 members.

Cellphone video of Garner’s July 17 arrest shows Pantaleo wrestling him to the sidewalk on Bay Street, with the white cop’s arms wrapped around the neck of the black suspect.

On the ground, Garner was heard repeatedly yelling “I can’t breathe!” as Pantaleo and other cops held him down and handcuffed him.

The Medical Examiner’s Office ruled Garner’s death a homicide caused by “compression of neck (chokehold), compression of chest and prone positioning during physical restraint by police.”

Police union leaders denied that Pantaleo used a chokehold — which is banned by the NYPD — and blasted the autopsy as part of a “political” witch hunt.

Garner’s family has filed notice it plans to sue the city for $75 million on grounds including wrongful death, pre-death pain and suffering, and civil rights violations.

The family and adviser the Rev. Al Sharpton have also repeatedly called on the feds to investigate his death.

In July, US Attorney General Eric Holder said the Justice Department was monitoring the case, and a group including Garner’s mom, widow and Sharpton met in August with Brooklyn US Attorney Loretta Lynch.

She has since been nominated by President Obama to replace Holder.

The rapper made the arrest known on Saturday with a series of tweets suggesting that he was a victim of racial profiling.

Hammer (who was born Stanley Kirk Burrell) was reportedly sitting in a car outside a shopping center in Dublin, a city east of Oakland, when he was approached by a police officer. “Chubby elvis looking dude was tapping on my car window, I rolled down the window and he said ‘Are you on parole or probation?'”

“While I was handing him my ID he reached in my car and tried to pull me out the car but forgot he was on a steady donut diet…. It was comical to me until he pulled out his guns, blew his whistle and yelled for help (MallCop) !!! But make no mistake he’s dangerous …. only thing more dangerous than a scared man with a gun, is a scared man with an agenda, a gun and a badge. I was citied for obstruction smh.”

According to the Dublin Police, Hammer was in a vehicle with expired registration, and he was not the registered owner. “After asking Hammer who the registered owner was he became very argumentative and refused to answer the officer’s questions,” police spokesman Herb Walters told CNN. Hammer was arrested on suspicion of resisting an officer and obstructing an officer in the performance of his duties; he was booked and released on bail from Santa Rita Jail, with a court date set for next month.

Hammer concluded his tweeted account of the incident by describing it as a “teachable moment” and an “eye opener.” “I will now answer his question,” he wrote. “contrary to his personal beliefs, all people of color are not on parole or probation fat boy!!!”

Hammer tell you are “2 Legit 2 quit”!

Rapper The Game ordered to pay North Carolina police $5 million

On Tuesday, a North Carolina appeals court judge upheld a prior ruling that orders Jayceon Taylor (better known as The Game) to pay $5 million in damages to 5 Greensboro police officers, according to a report from MYFOX8.

The suit dates back to a 2006 defamation suit filing by the 5 police officers. The suit accused The Game and Bungalo Records Inc. of libel and slander, claiming their identities were wrongfully used in a DVD titled, “Stop Snitchin’, Stop Lyin’,” a documentary produced by the accused. The documentary contains edited footage of The Game’s October 2005 arrest filmed by his crew at the Four Seasons Town Centre mall in North Carolina. After showing up at the mall loudly cursing and wearing a full Halloween mask to sign autographs, The Game was asked to leave by mall security for causing a disturbance. When he failed to comply, he was arrested soon after. Continue reading
